New allegations of child abuse in Jersey are being made as police continue their investigations at Haute de la Garenne.
Panorama has uncovered a number of alleged abuse cases at another home on the island and tracked down one of the abusers - believed by the police to be dead - but in reality very much alive and living in France.
When Haute de la Garenne was closed in 1986 the children were transferred to smaller units - one such unit was Blanche Pierre run by Jane and Alan Maguire, who for ten years opened their doors to troubled, lonely or vulnerable children.
Brutal regime
Panorama has spoken to seven former residents of the home who all recall abuse. All tell similar stories of being trapped in a brutal regime of physical and mental torture.
Former resident Jean Michel recalled: “Me and my sister would always argue over petty little things you know, end up in little squabbles from it, therefore you just sort of had a little sharp tongue, we’d have soap rammed down our throat for it…”
“It would be grated all along the back of your teeth and his nails would be all against the top of the roof of your mouth.”
Severe pain
Another former resident of Blanche Pierre, Darren said: “They put Dettol in my mouth and swilled it round and it went down my throat and it burnt my throat.
“I could hardly breathe, I was in severe pain, I was screaming because my throat swelled up, I could not breathe and I was burning because it’s undiluted Dettol in my mouth and my throat.
“(They) didn’t even take me to the doctors or anything. I couldn’t breathe properly, I couldn’t eat properly, I couldn’t talk properly and it hurt.”
A neighbour of the Maguire’s recalled some of the treatment given out to the children.
Joyce Symons said: “Darren an older child was put in the corner of the playroom and he was left there to stand sometimes all day in the corner and I would be by my kitchen and the window, my kitchen window looks into the playroom and he’d be stood there crying, a beautiful looking child and it used to make me cry and he used to be hit by what I thought was a stick.”
She said: “Alan Maguire was the one who inflicted the punishment and Jane Maguire would just sit by and let it happen.”

A teenage mother has been reunited with her baby after the child was taken by social services without a court order. The boy was taken two hours after he was born to the 18-year-old, who had just left the care of Nottingham social services.
Hours later, Mr Justice Munby at the High Court said no baby could be removed “as the result of a decision taken by officials in some room”.
The woman’s solicitor Stuart Luke said she would lodge a claim for damages.
‘Birth plan’
He said she faced the prospect of “an application by the local authority social services for an interim care order, which will be vigorously contested”.
Mr Justice Munby said that without the appropriate order and given that the mother was still in hospital, mother and child should be reunited.
Describing the situation as “most unfortunate”, he said officials involved in the case “should have known better”.
The boy was born healthy and taken from his mother about two hours after his birth without an order having been made.
Mr Luke, from the firm Bhatia Best, said: “Mother and child were reunited 46 minutes after Mr Justice Munby’s order at 1209 (GMT).”
Hospital staff were apparently shown a “birth plan” prepared by local authority social services.
‘Unfortunate removal’
The plan said the mother, who had a troubled childhood and suffered from mental health problems, was to be separated from the child, and no contact allowed without supervision by social workers.
The judge said the removal of a child could only be lawful if a police constable was taking action to protect a child, or there was a court order in place.
Mr Luke said the mother would be making a claim for damages against social services officials “arising out of the unfortunate removal of her child without lawful authority shortly after his birth”.
The judge ordered the council to prepare a comprehensive plan setting out their proposals to assist the mother as she had recently left local authority care, by no later than 8 February 2008.

Dear Janet McNamara

Thank You for your letter dated 20 March 08, with regards to the Adoption target’s I have full proof that they are still in force and did not end in 2006. The children that are still in care are sometimes being abused by there carers if you go to my Husband’s website you will see how many children have died while’s being in care. I am not saying that child abuse don’t go on I’m just saying that there are thousands of innocent parent’s out there that have not abused there children but are being accused of being a child abuser.

Half way down your second paragraph where you have said that there was never a financial incentive for local authorities to meet the national target, or for individuals Local Authorities is a lie because I have looked on every Local Authority website and there are target’s to meet and a cash bonus.

With regard to the third paragraph thanks for admitting that the local authorities get reward funding, I am not stupid I know what it mean’s every child that’s being looked after, the local authority as got a cash reward for adopting them.

By the way my child is part of your adoption racket, she has never been hurt nor would she ever be hurt if she came back into our care. The Local authorities take children on jump up allocations. In fact there is evidence on be my parent which is an adoption agency http//:www.bemyparent.co.uk. .

Local Authorities do not go by the law, they use force evidenced that’s flawed, and made up that the parent’s have emotionally abused the child, or the classic one is shaking baby syndrome. They steal babies from mother’s who have just giving birth without a Court Order, John Hemming the MP as over a thousand cases where the Social Services have come into the hospital without a Court Order and took the babies from new mums.

Social Services make parent’s do a number of assessments and if the family pastes the assessment they say the parent’s have failed. They make you believe that they are going to rehabilitate the child back to the parent’s but that’s a lie.

I watch television a lot and there as been so many story’s on there where a child as been abused by the parent’s and someone has reported it, but nothing gets done about it and the child or the children end up dead. Most of the children that go into care have not been abused at all they are there for the Adoption racket so the Local Authorities get there cash bonuses.
During Court Proceedings parent’s and the children are represented by solicitors unfortunly nearly all the solicitors and barrister’s work for the Local authorities which is not fair as they are suppose to work for the parent’s and what the children want.

Social Worker’s do remove children without out the parent’s consent, because it’s happen to me and my Husband, I was in the flat on my own in 2004 with our daughter because my husband when out with his dad. There was a knock on the door and two social worker’s and two police officer’s pushed there way in and stole my baby while’s she was still in her mosses basket, that wasn’t the only time I got her back for four months then they took her again with out a Court Order. So don’t tell me that Social Worker’s can’t remove children without the parent’s consent.

At how final hearing in 2006 the Court made a care order and a placement order at the same time. I want full openness with in the Court system, because the judges always go with the local authorities and do not listen to parent’s evidence.

See more money spend on this corrupted system so the Social Services can steal more children without proper evidence. I do not except that local authorities will make sure the children will stay with there families that is just a rouse to make us parent’s think we can keep our children,

Dear Mrs Walton

Thank you for your letter of 10 February to Kevin Brennan MP. I am sure you will appreciate that the Minister receives vast amounts of correspondence and is unable to reply to each one personally. On this occasion, I have been asked to reply on his behalf. Please accept my apologies for the delay in doing so.

The national adoption target for England ( covering the period April 2003 to March 2006), reflected the Government’s desire to reverse along term decline in the number of children already in care finding a permanent home through adoption. The intention of the target, which was largely achieved, was that thousands more of our most vulnerable children have had the chance to benefit from a stable, safe and loving family life, rather than remaining in care. There was never a financial incentive for local authorities to meet the national target, nor was the target allocated to individual local authorities. The target, having run its course and achieved its purpose, was not extended beyond March 2006. There are currently no plans to introduce a similar target.

Some local authorities have received “reward funding” through this process for increasing the number of children adopted from care – but this did not change the requirement that in each individual case adoption was in the child’s best interests and a court granted a placement order and, later, an adoption order. There is no evidence however that this has had any significant influence on the number of younger children (i.e. those under five) becoming looked after, as the overall figures for younger children becoming ‘looked after’ were virtually unchanged during the period in which the national target operated.

The 2006 Local Government White Paper commitments mean that the Government will only, from April 2008, agree target’s with local authorities against indicators drawn from the new national indicator set. There is no indicator within the national indicator set relating to the number of adoptions of children from care because the Government is content that the ‘backlog’ of children in care who were awaiting adoptive placements has been substantially dealt with in the period 2003 to 2006. There is, however, an indicator on the timeliness of placements for adoption. As central Government can only agree local targets that are based on the national indicator set, it will not in future be possible to agree with local authorities any targets to increase adoptions from care.

Legislation requires local authorities to ensure that children can live with their parents wherever possible, and that services should be provided to ‘children in need’ and their families to enable this to happen. The challenge for social workers is to keep children safe and, where possible, to keep families together. Sometimes this isn’t possible, so it is crucial that a child’s welfare is put first, and that they are effectively and speedily protected.

Sadly, thousands of children come into care every year because they cannot live at home in safety and young babies are the most vulnerable. In the court proceedings, the parent (and the child) is entitled to free legal aid enabling them to be legally represented.

Social Workers cannot remove children from their parents’ care (without the parents consent) without first referring the matter to a court and obtaining the authority of a court order. This is a fundamental safeguard in the care system. A court may only make a care order if it is satisfied that that the child concerned is suffering, or is likely to suffer, significant harm.

The development by local authorities of the view that a child should be placed for adoption is not made by one person but a range of people who scrutinise the adoption plan, in particular an Adoption Panel, most of the members of which are independent of the local authority. Only if the agency decision maker decides that adoption is in the best interests of a child can an application to the court for placement order is made (if the parents do not consent to adoption). It is then a matter for the court to decide whether to make a placement order and, later, an adoption order. No child is adopted from care without a court deciding it is in their best interests. This is a fundamental safeguard in the care system.

With regard to accountability in the courts, the government is developing pilots which will provide much more information to the public about family cases. The courts will be asked to produce a transcribed judgement or a decision summary or (in the family proceedings court) written reasons. The Government wants this information to be given to parents; retained for children so they can ask to see it when they become adults; and published anonymously so that the general public can easily access it.

The ‘Care Matters’ White Paper launched lat year set out a number of reforms which aim to make improvements in the care of vulnerable children. Spending to build upon these reforms will total £292 million over the period 2008-2011, and will include early identification and support to enable children who are at risk of going into care to remain with their families. Supplementing this, are proposals for a ‘gateway approach’ to family and friends care to make sure that it is considered as an option at the first and every subsequent stage of decision making about care and permanence options for a child- for example, by introducing a requirement that relatives and friends are, as far as possible, considered in all cases as potential carers as part of the care plan lodged with the court at the outset of care proceedings.

Shannon; police reject criticism (This Morning)

Police have insisted they did not ignore tip-offs about the location of missing schoolgirl Shannon Matthews.
Questions have been raised about why it took 24 days to find the nine-year-old less than a mile from her home in Dewsbury.
But Chief Superintendent Barry South, who is leading the investigation, has rejected the criticism of the inquiry.
He said: “Let me put on notice that, had we known at any time the whereabouts of Shannon, we would have been there within seconds.”
Ch Supt South would not be drawn on when the schoolgirl would be allowed to go home, saying: “That’s not for me to decide upon. We have got specialist people working with her.
“They will advise as to how that needs to happen and, more importantly, when it happens.”
Detectives have until lunchtime to question a 39-year-old man on suspicion of abduction.
Shannon was discovered in the base of a divan bed at the suspect’s flat in the Batley Carr area of Dewsbury, West Yorkshire, on Friday afternoon.
Her mother, Karen Matthews, released a statement backing the police’s decision to take Shannon into custody, saying: “I fully understand that the police need to keep speaking to Shannon.
